  1.  Categories of Personal Information We Collect About You

The type of information that we collect about you depends on your interaction with our Services and your relationship with us.  We collect and process, and in the preceding 12 months have collected and processed, the below categories and types of Personal Information with your consent or as otherwise required or permitted by law.  

  •  Contact and Profile Information.  We collect your full name, shipping address, email address, and mobile phone number (if you choose to apply two-factor authentication or sign up to receive SMS marketing messages from us). When you create an account on our Services, we will ask you to create a username (typically your email address), password, and to provide other security information for authentication and access. You can also choose to provide us with other profile information such as your shoe size and products you are following. We may also collect this information, as well as your date of birth, from you when you participate in sweepstakes or other promotional contests.
  •  Transaction Information: We collect records of products or services purchased, sold, obtained, or considered, purchasing or selling histories, product wish lists, and order histories. When you bid, ask, or complete a transaction on the Services, that information will be collected and tracked in your account with us.
  •  Financial Information.  When you make a purchase or sale via our Services, we collect payment card information, billing address, bank account, bank card, or digital payment services account information (e.g., PayPal, Venmo). This information is collected through a third-party payment gateway, so we do not store this payment information on our servers. Depending on your jurisdiction, you may also need to provide additional information related to taxes, customs and/or duties, for example, a VAT ID.
  •  Identity Verification Information.  Under certain circumstances and in accordance with various regulations, we may need to further verify the identity of a buyer or seller. To do this, we may request that you provide your date of birth, a government-issued identification number (e.g., VAT ID, SSN), government-issued photo identification, additional data such as tax identification number, and/or a live photo to our third-party identity verification provider. Our third-party identity verification provider will confirm the data provided. This identification verification process may also collect and use biometric data, which you can read more about our Biometric Data Policy (as described in Section 14 below).
  •  Device and Internet Data.  When you use our Services, we automatically collect (as described in Section 6 below) certain information about your device or Internet usage via automated web technologies. This information could include type of device or browser you’re using, time zone setting, browser plug-ins and operating system information, your IP address, and unique numeric identifiers associated with your device or browser.
  •  Online Behavior and Interaction with Our Site and Apps. Like most websites and apps, we automatically collect (as described in Section 6 below) certain information about your use of our Site and Apps via automated web technologies. This information could include your browsing behavior while on the Services, including products views or searched for, browsing time, download errors, and page interactions, URLs of websites you visited immediately before our Services, your interaction with our marketing messages, such as when you click on a link in an email or SMS message, and your interaction with our advertising partners, including advertisements you were shown, how often, when and where they were shown, and whether you took any action, such as clicking on the advertisement.
  •  Geolocation and Language Data.  When you visit our Sites or Apps, we may ask you to select your region and language to provide you with the relevant Services. We also automatically collect your general region or area from which you access our Services through the collection of your IP address.
  •  Content of Communications With Us. When you contact us via a contact form, email, phone, chatbot, or other means (e.g., to submit a query, or to report a problem with our Services), we may ask you to provide us with Personal Information, such as your name and contact details and language preference. In addition to that Personal Information, we will also collect and store the content, date, and time of your communication with us.
  •  Personal Information from Social Networks. We may collect Personal Information about you when you sign up or log in to our Services via third party platforms (such as Google, Facebook, Apple or Twitter). This information may include your social media user ID and information you share via comments, reviews, or posts on our social media pages.

  •  Directly from you. We collect Personal Information about you that you choose to provide directly to us and our service providers that collect the Personal Information on our behalf. This includes the following categories (as described in Section 1 above): Contact and Profile Information, Transaction Information, Financial Information, Identity Verification Information, Geolocation and Language Data, Content of Communications with Us, Social Networking Information, and Audio and Visual Information.
  •  Automatically Via Cookies.  Like most websites, when you use our Services or open our marketing messages, we automatically collect certain information about you or your use of our Site or Apps via automated means such as cookies, pixels, beacons, invisible tags, and similar technologies (“Cookies”). This includes (as described Section 1 above), Device and Internet Data, Online Behavior and Interaction with Our Site and Apps, and Geolocation Data.
  •  From other third parties. We also collect Personal Information about you from other sources and third parties. We may add this information to the information you provided to us or which we have already collected from you via our Services. This third-party information includes: Personal Information from Social Networks (e.g., social media user ID, posts on our social media pages hosted by third-party social networks), Personal Information from our Data Partners (e.g., marketing partners), and Information from Fraud Prevention and Identity Service Providers (e.g., when we ask these third-party service providers to confirm your identity or prevent fraud on the Services).

  •  For marketing and promotional purposes to perform marketing analysis and provide you with promotional updates and information about our products we feel may interest you, to improve our marketing efforts to you, and to provide you with information about us, including personalized marketing communications. You can opt-out of further marketing at any time by managing your account settings or selecting the “unsubscribe” link at the end of our marketing and promotional update communications to you. 
  •  To analyze and improve our Services and to support the development of new products and services.
  •  For the maintenance and improvement of our Sites and Systems, to provide and maintain functionality on our Sites and systems, and to help us diagnose technical and service problems and administer our Sites and systems.
  •  For security and fraud prevention to keep our Services safe and secure, including for fraud prevention via third-party identity verification services, to protect our Sites, premises, assets, systems, products, Services and intellectual property, including from fraud, theft, and misconduct, to enforce our policies and terms, and to conduct due diligence.
  •  For legal and compliance purposes, to enforce our legal rights and comply with our legal obligations, including reporting requirements, and to defend ourselves in legal proceedings, and to protect our company and our property, employees, and others through legal proceedings.

  1.  To Whom We Disclose Your Personal Information

We may share your Personal Information as described below:

  •  To the Mind Slides Group. We may share your Personal Information to any member of our group, which includes our subsidiaries, our ultimate holding company, and its subsidiaries, who support our processing of Personal Information.
  •  To our Service Providers.  We may share your Personal Information with our vendors and service providers who support the operation of our Services, Sites, and our business and who need access to such information to carry out their work for us (including, for example, cloud hosting, shipping carriers, payment processing, email delivery, marketing, identity verification services, insurance, application processing, operating systems and platforms, and customer support services, etc.).  In the past 12 months, we have shared identifiers, transaction and commercial data, and internet or electronic usage data to our service providers.
  •  To our Mind Slides Verified Sellers. We may share your Personal Information with our StockX Verified Sellers if you purchase a product from a StockX Verified Seller. In the past 12 months we have disclosed identifiers, transaction and commercial data, and internet or electronic usage data to our StockX Verified Sellers.
  •  To our Professional Advisors. We may also share your Personal Information with our professional advisors, such as lawyers, bankers, tax consultants, auditors, and insurers, where necessary in the course of the professional services that they render to us. In the past 12 months, we have disclosed identifiers, transaction and commercial data, and internet or electronic usage data to our professional advisors.
  •  To our Analytics/Advertising Partners.  We may share your Personal Information with third party analytics or advertising partners, including social media platforms and networks  who provide analytics or marketing and advertising services.  In the past 12 months, we have shared your Personal Information, identifiers, transaction and commercial data, and internet or electronic usage data to our advertising and analytics partners.
  •  To Governmental Entities.  We may share your Personal Information with regulatory and government entities including government, administrative, law enforcement and regulatory agencies, tax authorities, and other public agencies or authorities in order to comply with any applicable law, regulation, legal process or other legal obligation.  This includes cooperating with law enforcement when appropriate, obtaining legal remedies or limiting our damages, and to enforcing or protecting our contracts, legal rights or the rights of others, including by responding to claims asserted against us.   In the past 12 months, we have disclosed identifiers, commercial information, and internet or electronic usage data to government entities.
  •  To Parties to Corporate Transactions.  We may share information with potential investors, purchasers, merger partners, and their advisors in the event we: (i) sell or transfer, or are considering selling or transferring, all or a portion of our business or assets; or (ii) are considering or engaging in any reorganization, conversion, merger, sale, joint venture, assignment, transfer or disposition of all or any portion of our ownership interest, business or operations; or (iii) are soliciting or accepting investments.  
  •  With Your Consent.  We may disclose your Personal Information from or about you or your devices with your permission obtained in accordance with applicable law, including if you consent to the disclosure or direct us to disclose your information.

 

  1.  How Long We Keep Your Personal Information

We will retain your Personal Information for as long as we need it to provide you with access to our Services or to fulfill the purposes for which it was collected, as described in this Privacy Policy, unless a longer retention period is required by law or necessary to resolve disputes and enforce our agreements.  

Where we process Personal Information for marketing purposes, we process the data until you ask us to stop and for a short period after this request (to allow us to implement your requests).  We also keep a record of the fact that you have asked us not to send you direct marketing so that we can respect your request in the future.  

We use the following criteria to determine retention periods:

  •  how long the information is needed to provide our Services and operate our business;
  •  whether there is the possibility of your re-enrollment in our Services;
  •  the impact on our ability to provide you with certain features of our Services if we delete some information from or about you;
  •  whether information is needed to protect our business and mitigate risk;
  •  whether there are contractual or legal obligations that exist that require us to retain the information for a specific period of time;
  •  whether any law, statute, or regulation allows for a specific retention period;
  •  whether an individual has agreed to a longer retention period; and
  •  whether the data is considered to be sensitive data.

When the retention period is over, we will delete your Personal Information or keep it in a form that does not identify you when this retention period is over.

 

We may retain aggregate information beyond the retention period for research purposes and to help us develop and improve our Services. You cannot be identified from aggregate information retained or used for these purposes.
